Welcome to the online store of Dr Yolanda Vega (“we”, “us”, “this”). By placing an order through this shop, you agree to be bound by these Terms & Conditions (“Terms”).
Please read these Terms carefully before purchasing.
1. Products and Orders
a) We feature original artwork and items featuring that artwork. We do not personally manufacture all products: printing, production and fulfilment may be carried out by third-party suppliers and fulfilment partners, depending on region.
b) All orders placed via our website are subject to availability and confirmation of the order price. We reserve the right to refuse any order prior to dispatch.
c) When you place an order you will receive an email confirming receipt of your order (“Order Confirmation”). The contract between you and us is formed only when we send you a separate email confirming that the goods have been dispatched (“Dispatch Confirmation”).
2. Pricing and Payment
a) All prices are in Australian Dollars (AUD) unless otherwise stated, and exclude shipping and any applicable import duties/taxes unless explicitly stated.
b) We accept payment via the payment methods shown at checkout. Payment is taken at the time of order placement (or at our discretion as set out at checkout).
c) We may revise prices at any time, but the price charged to you will be the price displayed at checkout at the time of your order.
3. Shipping and Delivery
a) As indicated on the shop page, delivery times may vary according to the region, as products may be printed and shipped by sellers across various regions worldwide.
b) Estimated shipping/delivery times are provided as guidelines only. We are not responsible for any delays caused by international customs clearance, postal/courier service, import duties or other factors outside our reasonable control.
c) Title and risk of loss of the goods pass to you upon delivery to the carrier for shipment.
4. Returns, Refunds & Cancellations
a) Because products (custom-printed items or artwork and the book) are made to order, we are not be able to accept returns unless the product is defective.
b) In the case of defective goods, please notify us within 7 days of receipt and provide clear photographic evidence. We will arrange a replacement or refund if/when appropriate.
c) Any refund will be processed via the original payment method within 28 days.
5. Intellectual Property
a) All artwork, graphics, product designs and content featured in the shop remain the intellectual property of Yolanda Vega.
b) You may not reproduce, modify or commercially exploit any of our designs without our express written permission.
6. Limitation of Liability
a) Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, or for fraud.
b) Other than those liabilities which cannot be excluded by law, our total liability to you for any loss or damage arising out of or in connection with the goods shall be limited to the purchase price of the goods.
c) We are not liable for indirect or consequential loss or damage to any product.
7. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
8. General
a) If any part of these Terms is found to be invalid or unenforceable, the remainder of the Terms will remain in full force and effect.
b) We may revise these Terms at any time by posting an updated version on our website. You should check our website periodically to review the then current Terms.
c) These Terms constitute the entire agreement between you and us in relation to your purchase of goods from our shop and supersede all prior understandings, agreements or statements.
